Minutes:

1.       Councillor R Howse declared a registrable but non pecuniary interest in the application to be considered as he was a volunteer for the National Park Authority and covered the area in which it was situated.

To consider report number CLS72/15 of the Director of Corporate and Legal Services which is attached and which states that the Council as the Licensing Authority has received an application to licence premises under the provisions of the Licensing Act 2003 and the Committee is asked to consider the request in light of representations which have been received.

 

RECOMMENDATION:

 

It is recommended that the Committee determines the application in accordance with one of the options set out in paragraph 3.9 of the attached report.

The Committee considered report CLS72/15 of the Director of Corporate and Legal Services which requested the Committee’s consideration of an application to licence premises under the provisions of the Licensing Act 2003 in light of representations which had been received.  The application was made by Mr A W Hewitt and Mrs M P Hewitt, trading as Alston Old Hall Farm, for Lowther Barn Café, Beckside Farm, Sandwick, Martindale.  A licence had been requested permitting the sale of alcohol for consumption on the premises between the hours of 10am and 4pm daily, extending to 9pm during the hours of British Summer Time.

 

The Licensing Officer addressed the Committee and read out an explanation from Environmental Services as to why they had made no representations on the application before being questioned by Members and interested parties.

 

Mr De’Ath addressed the Committee on behalf of the applicants before being questioned by Members and other interested parties.

 

Mr Richard Lockett addressed the Committee on behalf of Kate Robinson who was unable to attend before being questioned by the applicant’s representative.

 

Mrs Jane MacAuliffe addressed the Committee.

 

Mr Richard Lockett addressed the Committee on behalf of Mr Will Lockett who was unable to attend.

 

Mr Martin Brimmer addressed the Committee on behalf of Martindale Parish Meeting before being questioned by the applicant’s agent.

Following withdrawal from the meeting at 10.35am of the Licensing Officers, applicants, interested parties, press and public, the Committee considered the matter and received legal advice on the options available.

 

Councillor Mrs J Raine left the meeting at 11.05am.

 

RESOLVED that the premises licence application be GRANTED permitting the retail sale of alcohol for consumption on the premises between the hours of 10am and 4pm daily, extending to 9pm during the hours of British Summer Time, subject to the applicable mandatory conditions and conditions consistent with the operating schedule.

 

The Licensing officers, applicants, other interested parties, press and public were readmitted to the meeting at 11.35am to be advised of the Committee’s decision and that they would receive the decision and reasons in writing.
