Members were advised of the applications requiring a decision by Members as detailed in a report of the Assistant Director Planning and Economic Development.

 

RESOLVED that:

 

1.       the following applications for planning permissions ("those applications") are determined as indicated hereunder;

 

2.       those applications which are approved be approved under the Town and Country Planning Act, 1990, subject to any detailed conditions set out in the Report, to any conditions set out below and to any conditions as to time stipulated under Sections 91 and 92 of the Act;

 

3.       those applications which are refused be refused for the reasons set out in the report and/or any reasons set out below;

 

4.       those applications which the Assistant Director Planning and Economic Development is given delegated powers to approve under the Town and Country Planning Act, 1990, be approved by him subject to any detailed conditions set out in the Report, to any conditions as to time stipulated under Sections 91 and 92 of the Act, to the receipt of satisfactory replies.

Minutes:

The Planning Services Development Manager informed the meeting that, subsequent to the full presentation heard at the previous committee, there had been further developments. The Applicant’s agent had provided more information in relation to the arboriculturalist’s assessment. Whilst the officer recommendation remained the same, the additional information provided resulted in the recommendation only relying on the heritage implications of the application, not the arboriculture implications.

That the application be approved, with delegated authority to officers to attach appropriate conditions, on the basis of Planning Policy LS1 recognising Greystoke as a key hub.

And RESOLVED that the application be REFUSED, in line with the officer recommendation, for the following reason:

 

The proposed dwellinghouse, use of land as domestic curtilage and potential loss of trees would cause considerable harm to the setting of listed buildings, resulting in moderate harm to the significance of these national heritage assets. There are insufficient public benefits to the proposal to outweigh this harm, nor any clear or convincing justification for such harm, which fails to conserve the significance of these listed buildings. As such, the proposal is contrary to Policy ENV10 of the of the Eden Local Plan 2014-32 and contrary to Sections 16 of the National Planning Policy Framework 2021, in particular paragraphs 195, 197, 199, 200, 202.
